課程目標:

All lectures deliver in English and start with a lecture introducing the disputes and the according consequences in construction engineering. Fundamental concepts of contract and tort law, claims, business formation and licensing, agency, and real property are then briefed. The main idea is to employ negotiation and mediation instead of litigation to resolve the most disputes. The primary pedagogical goal is to help student to understand and manage effectively in the negotiation process regarding the tension between creating and distributing value, the tension between the need to empathize with other side’s interests, the need to assert one’s own interests, and the tension between internal and external negotiations. Lectures also embrace the regarding theory and practice with an emphasis on negotiation skill building. This course helps student in understanding personalities, thinking styles, negotiation, and working with difficult people.

(本課程為全英語講授,由工程爭議起因與影響緣起,並介紹合約與過失求償等民法基本概念。課程主要動機在於法律爭訟之外引進談判與調處方法處理工程爭議。課程主要目的則在於幫助學生,明瞭談判與調處過程並能有效管理:包含如何面對壓力下之創造談判價值、瞭解自己與他方需求、以及組織內外之協商等。內容包含談判與調處理論與方法,課程同時講求對於各種不同人格特質、思考模式間如何達成協調合作。)
